Terms & Conditions 
ROCHA TRUCKING

1.   Legal Load: 2 Hours free on each end for loading and offloading, $100.00 per hour after.

2.   Delay/Demurrage: $950.00 per day.

3.   Oversize Loads: 2 Hours free on each end for loading and offloading, $125.00 per hour escort charges if applicable. Delay/Demurrage $1050.00 per day, plus escort charges if applicable.

4.   RTPI assumes No Liability for Cargo Loss, while loading/unloading, in transit, Cargo Theft, Cargo Damage, In USA or MEX.

5.   Multi-Axle: 2 Hours free on each end for loading and offloading, $195.00 per hour after each plus escort/3rd party charges if applicable. Delay/Demurrage: $1,950.00 per day each plus escort/3rd party charges if applicable. Escort cost to be determined at the time of move.

6.   In Calexico/Mexicali border 3 Days free at border then cost per day (trailer only): In other borders 1 day free then cost per day (trailer only):

-  Flatbed legal: $250.00

-  Legal step deck: $350.00

-  Oversize lowbed/step deck: $550.00

-  Oversize multi-axle: $1,000.00

7.   For other borders other than Calexico/Mexicali that trailer is dropped, there will be charges of truck waiting at border or traveling back to terminal or border.

8.   Loaded delay incurred will be subject to demurrage rates.

9.   Power to pull mechanical failures on the trailer is under client’s expense. Any delays caused by mechanical failure will be $150/hour starting on the third hour.

10.   Power Only: when pulling another carriers trailer, RTPI is not responsible for any damages or theft in Mexico.

11.   Weather delay, if applicable, will be subject to demurrage rates.

12.   Domestic driver fee ($350/load): This fee will apply to all layover loads to avoid violating the cabotage rule. This will avoid the risk of incurring federal fines, delays, or impoundment of goods.

13.   Load and Offload by others. RTPI is not responsible / liable for damages or loss during loading and unloading.

14.   No tarping included.

15.   Rates are subject to cancellation if not used within set dates on original Estimate.

16.   Advance partial payment will be necessary for Oversize / Overweight loads.

17.   Quote Subject to change. This quote is based on sight unseen dimensions and weight, rate may be impacted once verified.

18.   Quoted services are subject to availability at the time of confirmation.

19.   Accuracy of USA/MEX transportation permits is the client’s responsibility. Mexican permits not included in quote.

20.   Insurance coverage for Oversize. Overweight Load of $100,000 USD. If additional insurance is required, please notify RTPI in writing.

21.   An insurance extension coverage will be needed when the load exceeds 75ft in length, 12’6’’ ft in width and 14ft in height.These are loaded dimensions. This will be quoted separately, and client will cover the expense.

22.   No cargo insurance in Mexico, client is responsible for cargo insurance in Mexico.

23.   If cargo insurance is needed in Mexico, please notify RTPI in writing.

24.   Choice of Law and Venue: This Agreement shall be construed under and in accordance with the laws of the State of California. Any action to enforce the terms of this Agreement shall be brought in the Superior Court of California, for the County of Imperial, El Centro Courthouse.
25. Attorney fees: The prevailing party in any action, in any claim or action to enforce the terms of this Agreement shall be entitled to all costs and expenses incurred, including reasonable attorney’s fees.
